Terms & Conditions

A legal disclaimer

Effective Date: 14.03.2025

By booking a tour with Isleborn Tours, you agree to the following Terms and Conditions. Please read these terms carefully before making a booking. These Terms & Conditions outline the rights and responsibilities of both the customer (“you”) and Isleborn Tours (“we” or “us”).

1. Company Information

Business Name: Isleborn Tours
Business Address: Fjalsvegur 32, Faroe Islands
Contact Email: info@isleborn.com

2. Booking & Payment

  • Booking Channels: You may book a tour with Isleborn Tours online through our website, by phone, via email, through WhatsApp, or by other direct communication channels. We will confirm availability and details of the tour upon receiving your booking request.

  • Payment Requirements: Full payment of the tour price is required upfront at the time of booking to secure your reservation. We will provide you with an invoice or payment link, and your booking is not confirmed until full payment is received.

  • Accepted Payment Methods: We accept a variety of payment methods for your convenience, including credit cards (Visa, MasterCard, etc.), PayPal, Revolut, MobilePay, and bank transfers. All payments must be made in the currency and manner specified at the time of booking. Any processing fees or charges by your bank or payment provider are your responsibility.

3. Pricing

  • Inclusive Pricing: All tour prices quoted on our website or in our communications are inclusive of the stated itinerary features. This means the price of a tour includes all essential elements such as meals during the tour, entry fees to museums or attractions included in the itinerary, and the services of a tour guide.

  • No Hidden Costs: We believe in transparent pricing. The price you are quoted for the tour is the total price you will pay for the inclusions listed. There are no additional or hidden fees imposed by Isleborn Tours beyond the agreed price, unless you request extra services or upgrades that are not part of the standard tour package (in which case any additional costs will be clearly communicated and agreed upon in advance).

  • Price Changes: Tour prices are generally fixed once you have booked and paid. However, Isleborn Tours reserves the right to adjust the pricing of tours for future bookings. Any updated prices will be published on our website or communicated to you before you book. Price changes will not affect bookings that have already been confirmed with payment.

4. Cancellation & Refunds

Cancellation by Customer: If you need to cancel your tour booking, please notify us as soon as possible. Our cancellation policy is as follows:

  • Cancellations at least 2 weeks before the tour date: You will receive a full refund of the tour price.

  • Cancellations up to 48 hours before the tour start: You will receive a 50% refund of the tour price.

  • Cancellations less than 48 hours before the tour start: No refund will be issued.

Refund Processing: If you are entitled to a refund according to the policy above, we will process the refund through your original payment method. Refunds are typically issued within 1 to 8 days of the cancellation confirmation. Please note that your bank or payment provider may take additional time to post the refund to your account.

How to Cancel: To cancel a booking, you must contact Isleborn Tours via email, phone, or WhatsApp with your booking details. The time of cancellation will be determined based on when we receive your cancellation request.

5. Changes & Cancellations by Isleborn Tours

  • Right to Modify or Cancel: Isleborn Tours reserves the right to modify the tour itinerary or cancel a tour at any time, for any reason. This includes situations such as severe weather conditions, insufficient number of participants, safety concerns, or other unforeseen circumstances beyond our control. We strive to operate all tours as scheduled, but certain conditions may require adjustments for the safety and well-being of our guests and staff.

  • Notification and Alternatives: In the event that we must cancel or significantly change your tour, we will inform you as soon as possible using the contact information you provided. If we cancel a tour that you have booked, you will be offered alternative options whenever feasible. These options may include:

    • Rescheduling: Moving your booking to a later available date or a similar tour.

    • Substitute Tour: Booking a different tour of equal value.

    • Refund: Receiving a full refund of any payments you have made for the canceled tour.

We will work with you to find a satisfactory solution, but if none of the alternatives are suitable to you, a full refund will be provided. Isleborn Tours is not responsible for any additional expenses you may incur (such as travel or accommodation bookings) in preparation for the canceled tour.

6. Customer Responsibilities

  • Participation and Fitness: Our tours are designed to be accessible and enjoyable for a wide range of people. There are no specific health or fitness requirements to join an Isleborn Tours trip. Each activity during the tour is optional, and guests can choose which parts of the tour itinerary they wish to participate in according to their comfort and ability. However, it is your responsibility to assess your own fitness and health condition and to ensure that you are capable of participating in the tour activities you select. If you have any medical conditions or mobility issues that we should be aware of, please inform us in advance so we can accommodate you as much as possible.

  • Respectful Behavior: We expect all customers to behave respectfully and considerately at all times during the tour. This includes respecting the local residents, cultural norms, and communities we visit, following any rules or guidelines when entering museums or historical sites, and treating the natural landscape with care (e.g., no littering, no disturbing wildlife or plant life). You must follow the instructions of your tour guide and any official personnel (such as museum staff or park rangers) during the tour to ensure a safe and pleasant experience for everyone.

  • Personal Belongings: You are responsible for your personal belongings throughout the tour. Please take care of your items such as bags, cameras, phones, and travel documents. Isleborn Tours and its guides are not responsible for any personal items that are lost, stolen, or damaged during the tour. We recommend keeping valuables secure and being mindful of your belongings, especially when moving between locations or in public areas.

7. Liability

  • Assumption of Risk: By participating in an Isleborn Tours excursion, you acknowledge that there are inherent risks associated with travel and outdoor activities. You agree that you undertake the tour activities at your own risk. This means you are responsible for exercising caution and complying with safety instructions given by the tour guide or any relevant authority.

  • Limitation of Liability: Isleborn Tours, its owners, employees, agents, and guides shall not be held liable for any injuries, illnesses, accidents, loss of personal property, delays, or any other irregularities that may occur during the tour due to circumstances beyond our control. This includes (but is not limited to) accidents or incidents caused by third-party service providers (such as transportation companies or restaurants), acts of nature or weather, governmental actions, or any other event that we could not reasonably foresee or prevent.

  • No Liability for Indirect Costs: Isleborn Tours is not liable for any indirect or consequential losses, such as additional expenses, lost business or earnings, or other losses that may result from tour cancellations, delays, or changes. Our maximum liability to any customer, for any reason, is limited to the amount the customer has paid to Isleborn Tours for the relevant tour.

9. Governing Law & Dispute Resolution

  • Governing Law: These Terms & Conditions and any disputes arising from or relating to them or to the use of our services shall be governed by and construed in accordance with the laws of the Faroe Islands. This governing law applies no matter where in the world you access our services or tours.

  • Initial Resolution: In the event of any disagreement, concern, or dispute between you and Isleborn Tours, both parties agree to first attempt to resolve the issue informally and amicably. You should contact us with your complaint or issue, and we will do our best to address the matter promptly and fairly. Most concerns can be resolved quickly through open communication and mutual understanding.

  • Legal Action: If a dispute cannot be resolved informally, either party may seek to resolve the dispute through the courts or other legal avenues. Any legal action shall be brought in the appropriate courts of the Faroe Islands, and by agreeing to these terms, you consent to the jurisdiction of those courts for the purpose of resolving such disputes. Each party will bear its own legal fees and costs, subject to any court order or applicable law to the contrary.

10. Privacy

  • Data Collection: Isleborn Tours is committed to protecting your privacy. When you make a booking or fill out a form on our website, we collect personal information such as your name, contact details (email, phone number), and any other information necessary to process your booking and provide our services. This information is collected solely for communication and booking purposes. We use it to confirm your tour, send you updates or itineraries, and respond to your inquiries.

  • Use of Data: The personal data you provide will be used in accordance with applicable data protection laws. We do not sell, rent, or share your personal information with unrelated third parties for marketing purposes. However, we do use certain third-party services as part of our operations. For example, our website is hosted on the Wix platform, which may collect anonymous usage data or analytics information to help us improve our website functionality and user experience. Any data analytics by Wix or similar services are governed by their own privacy policies. Rest assured, any such usage data does not include your personal contact information, and Isleborn Tours does not divulge your personal details to any third party except as required to process your booking (for instance, providing your name to a hotel or service involved in your tour, if applicable).

  • Data Protection: We implement reasonable security measures to protect your personal information from unauthorized access or disclosure. You have the right to request access to the personal data we hold about you and to ask for corrections if needed. For more detailed information on how we handle personal data, please refer to our Privacy Policy (if available on our website) or contact us directly with any questions or requests regarding your data.

11. Force Majeure

  • Uncontrollable Events: Force Majeure refers to events or conditions beyond a party’s reasonable control that prevent fulfilling the terms of a contract. In the context of these tours, force majeure events include (but are not limited to) natural disasters, severe weather conditions, volcanic eruptions, earthquakes, floods, storms, strikes or labor disputes, war or civil unrest, government orders or restrictions, pandemics, or any other extraordinary events that were unforeseeable and unavoidable.

  • Impact on Tours: If any such force majeure event occurs that affects your tour, Isleborn Tours may have to change, postpone, or cancel the tour (even at short notice) for your safety and the safety of our staff. For example, severe weather in the Faroe Islands might result in ferry cancellations, road closures, or unsafe conditions that make it impossible to follow the planned itinerary.

  • No Liability for Force Majeure: In case of cancellations, delays, or changes to your tour due to force majeure, Isleborn Tours will not be considered in breach of these Terms & Conditions and is not liable for any compensation, damages, or losses resulting from such disruptions. We will, however, make reasonable efforts to offer an alternative solution when possible, such as rescheduling the tour or providing a credit for a future tour, depending on the circumstances and availability.

12. Changes to Terms & Conditions

  • Right to Update: Isleborn Tours reserves the right to update, revise, or modify these Terms & Conditions at any time. Changes may be made to reflect updates in our policies, changes in the law, improvements to our services, or for any other reason deemed necessary.

  • Notice of Changes: When we make material changes to these terms, we will update the "Effective Date" at the top of this document. We may also provide notice of significant changes via our website or by email if you have an upcoming booking. It is your responsibility to review the Terms & Conditions periodically to be aware of any updates.

  • Acceptance of Updated Terms: By continuing to use our website or services after any changes to these Terms & Conditions are posted, you accept and agree to be bound by the updated Terms & Conditions.
